Panipat: HRERA tightens noose around construction company pvt for delay in possession – The Tribune India

Tightening the noose around a private construction company, the Haryana Real Estate Regulatory Authority (HRERA) ordered the company to execute the deed of surrender in favor of the land owners and of villas within 45 days.

The company recovered full payment for the apartments, villas and land, as well as taxes and GST from the plaintiffs, but was slow to give them possession. Due to the delay, the owners were forced to live in rented accommodation. — Sachin Miglani, lawyer

The HRERA also ordered Eldeco Infrastructure and Properties Limited to pay 9.80% interest on the principal amount for delay in taking possession.

Sachin Miglani, attorney for plaintiffs Ankit Mittal, Saroj, Rakhi Tomar, Sanjay Kumar, Vikas Chaudhary and Vikas Bakshi, said the plaintiffs purchased villas and land with Eldeco Infrastructure and Properties Limited in Sector 40.

“The company recovered full payment for the apartments, villas and land, as well as taxes and GST from the plaintiffs, but was slow to give them possession,” he said.

“Due to the delay in taking possession, the owners were unable to build their houses and were forced to live in rented accommodation. This caused mental and financial loss to the owners,” the attorney said.

The company does not currently have an occupancy certificate (OC) and that is why it has not made a deed of transfer in favor of the owners.

The HRERA also ordered that the company could execute the deed of transfer if it did not have an OC, the order says.
